Delivery Options

  • We place great importance on the fast and reliable delivery of Customers orders, however please note that delivery times are estimates only and Fibercom Technologies LTD shall not be liable for delays.
  • If the Customer fails or refuses to take delivery of the goods, then in addition to all other rights and remedies of Fibercom Technologies LTD, the Customer shall be liable for all loss and damage (including consequential loss and damage) suffered or incurred by Fibercom Technologies LTD as a result thereof and Fibercom Technologies LTD, at its discretion may charge a restocking fee of up to 25% of the purchase price.
  • The goods shall be at the Customers risk at the point of delivery. The Customer, upon taking delivery of the goods, shall immediately examine the goods and give written notice to Fibercom Technologies of any defect within three (3) days of such date, failing in which the goods shall be deemed to have been delivered in good order and condition and accepted by the Customer.

Payment

  • The price shall be paid by the Customer in full without any deduction in respect of any claimed set-off or counterclaim (including any such set-off or counterclaim on account of any delay on the part of Fibercom Technologies LTD in delivering any part of the goods) on or before the payment date.
  • Unless otherwise stated, all charges/prices for Products shall be quoted in Kenya Shillings.
  • You will be responsible for payment of all taxes associated with your purchase of a Product, delivery thereof and utilization of the Product/Services and the amount payable for a Product shall include the cost of delivery of the Product to you.
  • Prices for our products are subject to change without notice.
  • We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
  • We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

Return Policy

  • Fibercom Technologies LTD will gladly refund or credit goods returned within a reasonable time (generally 3 days) provided the goods are in original condition, original packaging, current version and not a special order, hardware, peripheral or clearance item.
  • Otherwise, we will make our best effort to arrange exchange with the manufacturer or accept the goods back for resale
  • The return period in case of a defective product due to manufacturing defaults is strictly 24 hours from the date of sale.
  • Clients outside Nairobi should communicate to Fibercom Technologies to facilitate the return.
  • No returns will be accepted on products sold/delivered as sealed. Manufacturer warranty applies
  • A credit note for the full purchase price may be issued if returns take place within 48 hours provided goods are in their original packaging, including all manuals & software and are in a resalable condition.
  • Credit notes may be issued for goods returned after 48 hours from date of purchase but within 5(five) days.
  • All goods returned are to be correctly packaged. Specifically, goods must be returned in the packaging in which they were received, with all outer boxes and inner packaging intact. Items that are not correctly packaged will attract a minimum 15% handling charge.
  • Original invoices must be presented with all returns.
  • No credit will be issued at all if the return is more than 3 days after the purchase.

Warranty Information

  • Products sold by Fibercom Technologies LTD are covered by the manufacturers’ warranty that accompanies the product unless otherwise stated.
  • Fibercom Technologies LTD makes no additional or independent warranty.
  • Fibercom Technologies LTD does not warrant the performance, compatibility, integrity, merchantability and fitness for a particular purpose of any product, but merely passes through to the Customer whatever end-user warranty the manufacturers or software publishers provide with their respective products.
  • We do not warrant the suitability of goods. Please check the suitability of products with your system and/or the manufacturer before purchasing.
  • Products have a 12-month warranty from date of purchase, unless otherwise specified.
  • The warranty will be void if the serial number or its label is missing.
  • The warranty will be void if items are written on or tampered with.
  • Please Note: Due to restrictions placed upon us by the manufacturers, hardware that is defective on arrival can generally be exchanged if we are notified within 7 days of invoice. Otherwise, the manufacturer’s warranty process must be followed.

Manufacturer Warranty

  • For products with a manufacturer warranty, Fibercom Technologies LTD will not be liable in the event the manufacturer does not cover
  • For items with manufacturer warranty, clients will be required to take them to the warranty center in Nairobi CBD in person for faster service. Please ensure you carry a copy of your receipt/order.
  • All UPSs have a manufacturer warranty and Evercomps will only guarantee the unit for the first 7 days

Dealership Warranty

  • Units with a dealership warranty do not have a valid East African Manufacturer warranty as they are meant for sale in other regions.

Customer Acknowledgement

  • The Customer acknowledges agreement with these Terms and Conditions of Sale by the placement of an order to purchase product from Fibercom Technologies LTD.
  • All goods are supplied on these terms and conditions only and no person in the employment or otherwise as agent for Fibercom Technologies LTD has any authority to supply goods on any other terms and conditions or to vary these terms and conditions in any way whatsoever.
  • Previous dealings shall not vary or negate these terms and conditions in any respect.

VAT (Value Added Tax)

Our VAT according to the Kenyan Tax Regulations is charged at the rate of 16%
